The judgment of the Grand Chamber of the Court of Justice of the European Union, dated 1 October 2019, must be interpreted as meaning that consent is not validly given when the storage of information, or access to information already stored on the terminal equipment of a website user, through cookies is authorized by means of a box marked by default, which the user must uncheck if they wish to reject their use. In this sense, the authorization must be based on explicit consent through a Check of acceptance explicit, a check of rejection by the user, and a check of more information of the exposed cookies.
This interpretation cannot vary depending on whether the information stored or consulted on the user's terminal of a website consists of personal data or not.
The Grand Chamber of the Court of Justice of the European Union also stipulates in this judgment that the information that the service provider must provide to the user of an internet website must include the length of time cookies will remain active and the possibility of third parties accessing the information they store. This requirement is established in the version amended by Directive 2009/136, which modifies Article 5, paragraph 3, of Directive 2002/58/EU, and by the AEPD Guide of July 2020
